Mandatory Reporting of Child Abuse Ordinance comes into effect today

The Mandatory Reporting of Child Abuse Ordinance came into effect today (January 20). The Ordinance mandates 25 categories of specified professionals in the social welfare sector, education sector and healthcare sector to make a report as soon as practicable if there is a reasonable ground to suspect a child is suffering serious harm or is at real risk of suffering
serious harm that come to the notice of the professionals during the course of their work.
Any specified professional who fails to comply with the obligation to make mandatory reports under the Ordinance may result in a maximum penalty of three months' imprisonment and a fine of level 5 ($50,000). The Ordinance provides protection for specified professionals at the same time by prohibiting any person from inhibiting or obstructing the making of reports or disclosing the identity of specified professionals who made reports.
"The commencement of the Ordinance marks an important milestone in Hong Kong's efforts regarding child protection by creating a comprehensive and effective protection web for children," a spokesman for the Labour and Welfare Bureau said.

This platform is launched by the Government of the Hong Kong Special Administrative Region for specified professionals (mandated reporters) under the Mandatory Reporting of Child Abuse Ordinance (Ordinance) to report suspected serious child abuse in accordance with the statutory requirements.

嚴重傷害 (Chinese version only)
1. 任何危及兒童的生命的傷害,或任何危及兒童的身體健康而 急需醫治的傷害,包括—— (a) 喪失任何肢體或其功能; (b) 喪失視力或聽覺; (c) 任何內臟的損傷; (d) 任何骨折; (e) 身體表面的燒傷; (f) 導致神經線、肌肉或肌腱損毀或導致大量出血的損 傷;及 (g) 喪失知覺或知覺受損。
2. 任何危及兒童的心理健康或發展的傷害,包括—— (a) 精神錯亂;及 (b) 長期的心理創傷, 但不包括任何應對平常生活變故上的情緒反應 ( 例如感到困 擾、悲傷、恐懼和憤怒 )。
3. 任何由脅迫或誘使兒童參與以下作為,所造成的傷害—— (a) 強姦; (b) 亂倫;(c) 肛交; (d) 性交;或 (e) 任何嚴重猥褻作為。
4. 任何由某兒童的負責人的疏忽照顧所造成的、危及該兒童的 生命或健康的傷害,包括—— (a) 沒有為該兒童提供必需品,以維持其生命或健康; 及 (b) 將該兒童置於危及其生命或健康的情況 ( 例如容許 該兒童接觸或服用任何危險藥物或物質 ) 或環境。
